Business ethics and firm economic performance have traditionally often been regarded as mutually exclusive ends. We challenge this “either-or” belief and analyze when and how ethical firm leadership and firm performance may harmonize well. In extension of earlier research on ethical leadership and performance at the individual and team level, we study the context–dependency of the organization level relationship between CEO ethical leadership and firm performance. We propose a moderated mediation model of the link between CEO ethical leadership and firm (...) performance, identifying mediating and moderating variables unique to the organization-level of analysis. CEO ethical leadership is argued to work through organizational ethical culture which promotes firm performance under the condition that there is a strong corporate ethics program in place. Results from a multisource cross-sectional study, in which we surveyed 145 participants from 32 organizations and validated organizational performance ratings by objective performance data, showed support for our conceptual model. Current literature on ethical leadership and unethical leadership reflects a Western-based private sector perspective, pointing toward a compliance-oriented understanding of ethical and unethical leadership. As today’s executives increasingly have to ethically lead across different cultures and sectors, it becomes vitally important to develop a more holistic picture how ethical and unethical leadership is perceived in the Western and Eastern cultural cluster and the private and the public/social sector. Addressing this issue, the present study aims to identify cross-cultural and cross-sectoral commonalities (...) and differences in international executives’ perceptions of ethical and unethical leadership. Findings from in-depth interviews (N = 36) with executives from Western and Eastern cultures working in the private or the public/social sector reveal collectively held perceptions of ethical leadership (including leader honesty, integrity, concern for responsibility/sustainability, and people orientation) and of unethical leadership (referring to leader dishonesty, corruption, egocentrism, and manipulation). Results indicate limited support for a compliance-oriented perspective on ethical and unethical leadership but yield a much greater trend toward a value-oriented perspective. Concrete practice examples illustrate these different perspectives. Cultural and sectoral particularities of executive perceptions of ethical and unethical leadership are discussed. (shrink)

This is the first comprehensive study of Nietzsche's earliest (and extraordinary) book, The Birth of Tragedy (1872). When he wrote it, Nietzsche was a Greek scholar, a friend and champion of Wagner, and a philosopher in the making. His book has been very influential and widely read, but has always posed great difficulties for readers because of the particular way Nietzsche brings his ancient and modern interests together. The proper appreciation of such a work requires access to ideas that cross (...) the boundaries of conventional specialisms. This is now provided by M. S. Silk and J. P. Stern in their joint study of Nietzsche's book. They examine in detail its content, style and form; its strange genesis and hybrid status; its biographical background and the controversy engendered by its publication; its value as an account of ancient Greek culture and as a theory of tragedy and music; its relation to other theories of tragedy; and its place in the history of German ideas and in Nietzsche's own philosophical career. This paper examines distinctive discourse properties of preposed negative 'yes/no' questions (NPQs), such as 'Isn’t Jane coming too?'. Unlike with other 'yes/no' questions, using an NPQ '∼p?' invariably conveys a bias toward a particular answer, where the polarity of the bias is opposite of the polarity of the question: using the negative question '∼p?' invariably expresses that the speaker previously expected the positive answer p to be correct. A prominent approach—what I call the context-management approach, developed most extensively by Romero (...) and Han (2004)—attempts to capture speaker expectation biases by treating NPQs fundamentally as epistemic questions about the proper discourse status of a proposition. I raise challenges for existing context-managing accounts to provide more adequate formalizations of the posited context-managing content, its implementation in the compositional semantics and discourse dynamics, and its role in generating the observed biases. New data regarding discourse differences between NPQs and associated epistemic modal questions are introduced. I argue that we can capture the roles of NPQs in expressing speakers’ states of mind and managing the discourse common ground without positing special context-managing operators or treating NPQs as questions directly about the context. I suggest that we treat the operator introduced with preposed negation as having an ordinary semantics of epistemic necessity, though lexically associated with a general kind of endorsing use observed with modal expressions. The expressive and context-managing roles of NPQs are explained in terms of a general kind of discourse-oriented use of context-sensitive language. The distinctive expectation biases and discourse properties observed with NPQs are derived from the proposed semantics and a general principle of Discourse Relevance. (shrink)

It is common to think that what theory of linguistic vagueness is correct has implications for debates in philosophy of law. I disagree. I argue that the implications of particular theories of vagueness on substantive issues of legal theory and practice are less far-reaching than often thought. I focus on four putative implications discussed in the literature concerning (i) the value of vagueness in the law, (ii) the possibility and value of legal indeterminacy, (iii) the possibility of the rule of (...) law, and (iv) strong discretion. I conclude with some methodological remarks. Delineating questions about conventional meaning, the metaphysics/metasemantics of (legal) content determination, and norms of legal interpretation and judicial practice can motivate clearer answers and a more refined understanding of the space of overall theories of vagueness, interpretation, and law. Putting laypeople in an active role as direct expert contributors in the design of service robots becomes more and more prominent in the research fields of human–robot interaction and social robotics. Currently, though, HRI is caught in a dilemma of how to create meaningful service robots for human social environments, combining expectations shaped by popular media with technology readiness. We recapitulate traditional stakeholder involvement, including two cases in which new intelligent robots were conceptualized and realized for close interaction with humans. (...) Thereby, we show how the robot narrative together with aspects of power balancing stakeholders, such as hardware constraints and missing perspectives beyond primary users, and the adaptivity of robots through machine learning that creates unpredictability, pose specific challenges for participatory design processes in HRI. We conclude with thoughts on a way forward for the HRI community in developing a culture of participation that considers humans when conceptualizing, building, and using robots. (shrink)

Today many scholars seem to agree that citizens should be involved in expert deliberations on science and technology issues. This interest in public deliberation has gained attraction in many practical settings, especially in the European Union, and holds the promise of more legitimate governance of science and technology. In this article, the authors draw on the European Commission’s report ‘‘Taking the European Knowledge Society Seriously’’ to ask how legitimate these efforts to ‘‘democratize’’ scientific expertise really are. While the report borrows (...) from deliberative democrats’ normative accounts of legitimacy, the authors identify a tension between the principles for legitimate rule prescribed by deliberative democratic theory and the report’s celebration of diversity and dissent. While this inconsistency suggests that the legitimacy of deliberative governance arrangements is justified on empirical rather than normative grounds, it remains an open question whether studies of science and technology offer enough empirical support for such a justification. In this article, the authors address this pressing question and propose three possible responses. (shrink)

The mainstream literature on corporate governance is based on the premise of conflicts of interest in a competitive game played by variously defined stakeholders and thus builds explicitly and/or implicitly on masculinist ethical theories. This article argues that insights from feminist ethics, and in particular ethics of care, can provide a different, yet relevant, lens through which to study corporate governance. Based on feminist ethical theories, the article conceptualises a governance model that is different from the current normative orthodoxy.

This paper studies the effects of social comparison on risk taking behavior. In our theoretical framework, decision makers evaluate the consequences of their choices relative to both their own and their peers’ conditions. We test experimentally whether the position in the social ranking affects risk attitudes. Subjects interact in a simulated workplace environment where they perform a work task, receive possibly different wages, and then undertake a risky decision that may produce an extra gain. We find that social comparison matters (...) for risk attitudes. Subjects are more risk averse in the presence of small social gain than social loss. In addition, risk aversion is decreasing in the size of the social gain. (shrink)

Research focusing on Anglo-European languages indicates that children’s acquisition of the subordinate structure of complement-clause constructions and the semantics of mental verbs facilitates their understanding of false belief, and that the two linguistic factors interact. Complement-clause constructions support false-belief development, but only when used with realis mental verbs like ‘think’ in the matrix clause (de Villiers, Jill. 2007. The interface of language and Theory of Mind.Lingua117(11). 1858–1878). In Chinese, however, only the semantics of mental verbs seems to play a facilitative (...) role in false-belief development (Cheung, Him, Hsuan-Chih Chen & William Yeung. 2009. Relations between mental verb and false belief understanding in Cantonese-speaking children.Journal of Experimental Child Psychology104(2). 141–155). We argue that these cross-linguistic differences can be explained by variations in availability and usage patterns of mental verbs and complement-clause constructions across languages. Unlike English, Mandarin-Chinese has a verb that indicates that a belief might be false:yi3wei2‘(falsely) think’. Our corpus analysis suggests that, unlike English caregivers, Mandarin-Chinese caregivers do not produce frequent, potentially unanalyzed, chunks with mental verbs and first-person subjects, such as ‘I think’. In an experiment, we found that the comprehension of complement-clause constructions used withyi3wei2‘(falsely) think’, but not withjue2de2‘think’, predicted Mandarin children’s false-belief understanding between the ages of 4 and 5. In contrast to English, whether mental verbs were used with first- or third-person subjects did not affect their correlation with false-belief understanding. (shrink)

Im Zuge einer Änderung des Arzneimittelgesetzes im November 2016 hat der Deutsche Bundestag beschlossen, dass gruppennützige Arzneimittelforschung mit nicht-einwilligungsfähigen Erwachsenen unter bestimmten Bedingungen erlaubt sein soll. Das entsprechende Gesetz wird voraussichtlich im Jahr 2020 in Kraft treten. Das ethische Problem dieser Forschung besteht darin, dass Personen, die nicht in der Lage sind, ihre Einwilligung in die Forschung zu erteilen, nicht vom medizinischen Fortschritt ausgeschlossen werden sollen. Der Gesetzgeber hat versucht, diesen Konflikt zu lösen, indem er die Zulässigkeit der gruppennützigen Forschung (...) mit nicht-einwilligungsfähigen Erwachsenen an die Voraussetzung geknüpft hat, dass Studienteilnehmer ihre Einwilligung zuvor in einer Probandenverfügung erteilen. Der Beitrag hat das Ziel, die neue Regelung zur gruppennützigen Forschung mit nicht-einwilligungsfähigen Erwachsenen aus ethischer Sicht zu bewerten. Die Frage, ob die Gesetzesänderung weitere Forschung ermöglichen wird, hängt wesentlich davon ab, ob man mit Blick auf Studien, die sowohl eigennützige als auch gruppennützige Maßnahmen umfassen, eine Gesamtbetrachtung oder eine Einzelbetrachtung dieser Studien vorzieht. In unserem Beitrag argumentieren wir für eine Einzelbetrachtung. Es wird weiterhin die Auffassung vertreten, dass die im Gesetzgebungsverfahren vorgeschlagene Probandenverfügung die Selbstbestimmung der Patienten fördern kann, wenn sie mit Blick auf die mit der Teilnahme verbundenen Eingriffe ein Mindestmaß an Bestimmtheit erreicht.Zusammenfassend wird die Auffassung vertreten, dass gruppennützige Forschung mit nicht-einwilligungsfähigen Erwachsenen trotz der genannten Bedenken unter bestimmten Bedingungen ethisch zulässig sein kann. In der Gesamtabwägung erscheint dabei die eindeutige Definition und strenge Beachtung der Bedingungen der EU-Verordnung 536/2014 mit Blick auf einen ethisch gerechtfertigten Einbezug von nicht-einwilligungsfähigen Erwachsenen in gruppennützige Forschung als besonders bedeutsam. From the perspective of gender theory, the intersections among gender, class, and race make it difficult, if not impossible, to assign political issues and identities to just one social movement. Instead, the negotiation of movement ownership of issues and identities occurs through interaction among social movements, including interactions that create denial and distance. This article takes the interaction of labor organizing and feminism as the lens for studying movement interaction at three levels: opportunity structure, organizing practices, and framing ideas. Using (...) a case study of a strike of day care workers in West Berlin in the winter of 1989-90, it contrasts inclusive and exclusive forms of solidarity and their consequences for organizational practices. This particular strike received little support from either feminists or the labor movement and eventually failed, an outcome that can be seen as reflecting the weakness of structural and organizational supports for frames favoring inclusive solidarity. Although the main responsibility for informed consent of medical procedures rests with doctors, nurses’ roles are also important, especially as patient advocates. Nurses’ preparation for this role in settings with a hierarchical and communal culture has received little attention. We explored the views of hospital managers and nurses regarding the roles of nurses in informed consent and factors influencing these roles. We conducted a qualitative study in a private, multispecialty hospital in Indonesia. Semi-structured interviews were conducted with seven managers. Two (...) rounds of focus group discussions with nurses (n = 27) were conducted. Constant comparative approach was used in the analysis. Nurses can act as manager, witness, information giver, and advocate in the informed consent process. These roles are influenced by nurses’ preparedness, hospital culture and policy, patients’ understanding, family involvement, and cost-related issues. In preparation for these tasks, nurses should acquire communication skills, clinical knowledge, and legal and ethical knowledge. (shrink)

From his involvement with these texts come the numerous and sometimes extensive quotations from patristic texts in the Annotata of De veritate religionis Christianae, which accompanied the work starting in 1640. Grotius was particularly interested in the apologetic literature of the ancient Church, which can also be seen in his correspondence. Strikingly, Grotius cites individual passages from texts that (...) had not yet appeared in print, which he could only have learned of from the circle of those who, in 1630s Paris, were working to produce editions of various Greek texts. The texts in question are Cyril of Alexandria, Contra Julianum, and the letter of Barnabas. Grotius had received a handwritten copy of the Barnabas letter, which he later bound into his notebook amid excerpts of patristic texts. This shows the high level of detail at which Grotius knew the patristic texts, and how he moved in the intellectual circles of Paris. (shrink)

The use of patristic texts was tightly bound up with the needs of the contemporary discussion which provided Grotius with sources for his patristic citations. His use of ancient texts especially in Ordinum Hollandiae ac Westfrisiae pietas proved to be highly controversial.Grotius's advocacy of tolerance with respect to various forms of Christianity determines his use of patristic texts as well. He looks for examples of moderation in the Early Church and by this accomplishes a significant shift of perspective. He points (...) out the diversity of expressions in the Early Church and therefore replaces questions of dogmatic definition with the question of how to handle orthodoxy and heresy in society. In doing so, he implies requirements for the proper reading of patristic texts in his own times. Grotius's notion of Christian liberty is connected to awareness of context and intrinsically linked to a historical understanding. In his writings, contextualisation involves both religious-historical comparison and the integration of general sources from antiquity. With regard to early Christian sources, this means that Grotius understands them as deeply rooted in the broader ancient context. This approach to early Christian literature is already visible in De Iure Praedae. His sensibility for cultural variation, his comparative method and historical interest in ancient institutions are outstanding, and Grotius has these characteristics in common with legal humanists like François Baudouin. In the asymptotic safety paradigm, a quantum field theory reaches a regime with quantum scale invariance in the ultraviolet, which is described by an interacting fixed point of the Renormalization Group. Compelling hints for the viability of asymptotic safety in quantum gravity exist, mainly obtained from applications of the functional Renormalization Group. The impact of asymptotically safe quantum fluctuations of gravity at and beyond the Planck scale could at the same time induce an ultraviolet completion for the Standard Model of (...) particle physics with high predictive power. Research on the cognitive abilities involved in decision making has shown that, under objective risk conditions (i.e., when explicit information about possible outcomes and risks is available), superior decisions are especially predicted by executive functions and exact number processing skills, also referred to as objective numeracy. So far, decision-making research has mainly focused on exact number processing skills, such as performing calculations or transformations of symbolic numbers. There is evidence that such exact numeric skills are based on approximate number processing (...) (ANP) skills, which enable quick and accurate processing of non-symbolic numbers (e.g. Chen and Li, 2014). Very few studies, however, have investigated ANP skills in the context of risky decision making and have analyzed direct associations among the aforementioned sub functions. Possible interactions between the closely related skills have not been considered. The current study (N = 128) examines interactions of ANP skills with executive functions and objective numeracy, in predicting risky choice behavior. ANP skills are represented by the accuracy in a dot-comparison task. Decision making is measured by two versions of the Game of Dice Task (GDT), which place different emphases on the reflection of potential risks. The results show two-way as well as three-way interactions between the measures of ANP skills, executive functions, and objective numeracy in predicting risky decisions in both GDT versions. The riskiest decisions were most frequently made in case of low scores in all of the three competencies, while good performance in any one of them resulted in significant reductions of disadvantageous decisions. The findings indicate that high ANP skills can positively affect choice behavior in individuals who have weaknesses in reflectively attributed skills, namely executive functions and objective numeracy. Potential compensatory effects and mechanisms of ANP in decision making are discussed. (shrink)
